Terms and Conditions  Agreement

These conditions explain the rights, obligations, and responsibilities of all parties to this Agreement.
‘You’ / ‘Your’ refers to the Customer.
‘We’ / ‘Us’ / ‘Our’ refers to the Remover/Storage Provider.

These terms may only be varied by prior written agreement.
Please review Clauses 8, 9, 10, and 11 carefully, as they limit our liability. We recommend obtaining specialist insurance. Insurance, where provided by us, is arranged separately under our master policy.

1. Quotation

1.1 Quotation excludes:

  • Insurance

  • Customs duties, inspections, and taxes

  • Governmental fees

1.2 Adjusted or additional charges may apply where:

  • Quote not accepted within 28 days

  • Work delayed beyond 3 months

  • Changes due to currency, tax, or freight fluctuations

  • Work is scheduled outside 08:00–18:00 or on weekends/holidays

  • Goods are collected/delivered above first floor

  • Collection from warehouse is requested

  • Additional services or goods are added

  • Limited access requires mechanical equipment or alterations

  • Parking or other fees are incurred

  • Delays arise outside our control

  • Liability limits are increased by agreement

2. Work Not Included

2.1 Unless agreed in writing, we will not:

  • Dismantle or assemble flat-pack furniture

  • Disconnect/reconnect appliances or fixtures

  • Take up or lay fitted flooring

  • Move items from unsafe lofts

  • Handle prohibited or restricted items (see Clause 4)

2.2 We recommend engaging qualified professionals for such tasks.

3. Your Responsibilities

You must:

  • Declare the value of goods in writing

  • Arrange adequate insurance

  • Obtain necessary permits and documentation

  • Be present or represented at collection/delivery

  • Sign relevant inventory, receipt, or waybill documents

  • Ensure only intended goods are removed

  • Secure goods at unattended premises

  • Stabilize appliances and defrost refrigerators

  • Provide up-to-date contact details

  • Confirm access dimensions and floor strength

We are not liable for any costs arising from failure to meet these obligations, unless due to our negligence or breach of contract.

4. Excluded Goods

Without prior written consent, we will not move or store:
4.1.1 Dangerous or illegal goods (e.g. firearms, gas, chemicals, drugs)
4.1.2 Valuables (e.g. jewellery, money, deeds, collectibles)
4.1.3 Plants or items prone to pest infestation
4.1.4 Perishables or items needing climate control
4.1.5 Animals, birds, fish
4.1.6 Goods needing special licenses

If such goods are included without notice:

  • We may return or seek legal disposal

  • You will bear all associated costs and liabilities

5. Ownership Warranty

You warrant that:

  • You own or are authorized to move/store the goods

  • All relevant parties have been informed of these terms

  • You indemnify us against claims arising from false declarations

6. Postponement or Cancellation

If you cancel/postpone:

  • >10 working days: No charge

  • 5–10 working days: Up to 30% of the charge

  • <4 working days: Up to 60%

  • <1 working day: 100% charge

7. Payment Terms

7.1 Unless agreed otherwise:

  • Payment is due in full, in advance

  • Withholding payment is not permitted

  • Overdue accounts bear interest at 4% above the SARB base rate

8. Liability for Loss or Damage

We accept no liability whatsoever for any loss of or damage to goods submitted for removal, transit, or storage, however caused.

8.2 This exclusion of liability applies to, but is not limited to:

  • Theft

  • Fire

  • Water damage

  • Vermin or infestation

  • Mould or mildew

  • Environmental or weather-related damage

  • Handling, loading, or unloading

  • Mechanical failure, breakdown, or accidental damage

  • Loss of data or functionality in electronic equipment

8.3 You are strongly advised to arrange adequate insurance to cover your goods for the full replacement value, at your own cost.
We can assist in arranging such insurance under a separate agreement, but this is not included by default.

8.4 We shall not be liable for:

  • Any consequential loss (including lost profits or income)

  • Emotional or sentimental value

  • Delay in delivery or retrieval

  • Failure of goods to function after transit

9. Transit Delays

We are not liable for delays unless due to our negligence.
If delivery is impossible through no fault of ours, we may store goods at your cost, fulfilling the contract.

10. Right to Withhold Goods (Lien)

We have a lien on goods for all unpaid charges, including:

  • Storage

  • Services

  • Removal

  • Additional services

  • Disbursements on your behalf

We may withhold goods until payment is received and charge for ongoing storage and related costs.

11. Disputes

Unresolved disputes may be referred to arbitration (by agreement) through the Chartered Institute of Arbitrators. Arbitration costs will be at the arbitrator’s discretion. You retain the right to pursue court proceedings.

12. Subcontracting

12.1 We may subcontract part or all of the work.
12.2 These terms remain fully applicable.

13. Routes and Methods

13.1 We choose transport routes and methods.
13.2 Unless otherwise agreed, space in our vehicles may be shared with other clients' goods.

14. International Advice

We may offer guidance on import/export processes in good faith, but it is your duty to verify all legal and regulatory requirements.

15. Applicable Law

This agreement is governed by the laws of the country in which our issuing office is located.

16. Forwarding Address

16.1 You must provide and update a valid contact address.
16.2 If unreachable, notices may be published publicly at your cost. We may charge fees to locate you.

17. Inventory or Receipt

Inventories or receipts are deemed accurate unless contested in writing within 10 days.

18. Storage Rate Adjustments

Storage charges may be revised with 3 months’ written notice.

19. Right to Sell or Dispose of Goods

If payment is overdue and remains unpaid after 3 months’ written notice, we may:

  • Require removal of goods

  • Sell or dispose of goods without further notice

  • Deduct all costs of sale or disposal

  • Credit any surplus to you (without interest)

  • Pursue legal action for any shortfall

20. Termination

  • We may terminate with 3 months’ notice, provided all payments are current

  • You must provide 10 working days’ notice for termination

  • Storage charges remain payable up to the effective date
